The Construction (Design and Management) Regulations 2015 (the Regulations) came into force on the 6th April 2015 and replaces the previous CDM 2007 regulations.

The Regulations apply to all construction projects in Great Britain including projects undertaken by domestic clients and place duties upon the client, the designers, the contractor(s) and all workers.

A key client duty is the appointment of a principle designer and principle contractor, which must be done where there is more than one contractor working on a project at any time. Other client duties include:

  • Make sure other duty holders are appointed.

  • Make sure sufficient time and resources are allocated.

  • Relevant information is provided to other duty holders.

  • Make sure the principle designer and principle contractor carry out their duties.

  • Make sure welfare facilities are provided.

The Regulations assumes that the client is competent to discharge their duties or has access to competent external advice as required by the Health and Safety at Work Act 1974 and the Management of the Health and Safety at Works Regulations 1992.

CHPK can provide that competent advice to assist clients and/or principal designers in the discharge of their duties under the Regulations where they feel they are not capable of doing so. Alternatively, we can act as Principal Designer on your project and  co-ordinate health and safety matters.

Our approach to health and safety is a proactive not a restrictive one. We are there to assist the wider team in producing excellent designs which can be built and maintained safely while making sure all duty holders are complying with the Regulations.
